Blue Goat Landscape Services provides residential and commercial outdoor property services, which may include, but are not limited to:
The specific services to be performed will be determined by the approved estimate, proposal, work order, or service agreement.
All estimates and proposals are based on the information and conditions reasonably visible or known at the time the estimate is prepared.
An estimate may include labor, materials, equipment, delivery, disposal, and other services specifically described in the proposal.
Approval of an estimate authorizes Blue Goat Landscape Services to perform the work described in the approved scope.
Unless otherwise stated in writing, an estimate is not a guaranteed final price when additional work, customer-requested changes, or conditions outside the original scope require additional labor or materials.
Approval may be provided by signed document, electronic approval, text message, email, Jobber approval, verbal authorization, or other documented communication confirming authorization to proceed.
Blue Goat Landscape Services will perform the services specifically described in the approved estimate, proposal, work order, or service agreement.
Work outside the original scope may result in additional charges. Additional work may include, but is not limited to:
When practical, Blue Goat Landscape Services will communicate additional costs to the Customer before proceeding.
In situations where immediate action is reasonably necessary to continue or protect the work, the Company may perform necessary additional work and document the additional charges.
Changes requested by the Customer after approval of the original estimate may result in additional labor, material, equipment, delivery, or disposal charges.
Customer-requested additions or changes may also affect the original completion date.
Blue Goat Landscape Services is not required to perform additional work without authorization when the requested work is outside the approved scope.
Blue Goat Landscape Services will make reasonable efforts to use the materials, plants, irrigation components, sprinkler equipment, and other products specified in the approved estimate.
However, availability may change. If a specified product or material becomes unavailable, discontinued, or excessively delayed, Blue Goat Landscape Services may recommend a comparable substitute.
Any significant substitution affecting price or scope will be communicated to the Customer when reasonably practical.
Plant varieties, colors, sizes, brands, sprinkler components, and other materials may vary depending on availability.
Irrigation and sprinkler services may include installation, repair, adjustment, troubleshooting, replacement, wiring, valves, sprinkler heads, nozzles, controllers, timers, and related components.
Blue Goat Landscape Services will make reasonable efforts to identify and correct irrigation problems based on the conditions accessible at the time of service.
Irrigation systems may contain underground components, wiring, pipes, valves, connections, or other conditions that are not visible before excavation or testing.
Repairs to one portion of an irrigation system do not guarantee that other portions of an existing system will operate properly.
Blue Goat Landscape Services is not responsible for failures of existing irrigation components that were not installed or replaced by the Company unless otherwise agreed in writing.
The Customer understands that landscaping and irrigation work is often performed on existing properties and systems.
Existing conditions may include:
Blue Goat Landscape Services is not responsible for pre-existing conditions that were not caused by the Company.
When such conditions affect the work, additional repairs or materials may be necessary and may result in additional charges.
The Customer is responsible for providing reasonable access to the property and work areas on the scheduled service date.
The Customer should ensure that gates are unlocked, irrigation equipment is accessible, and work areas are reasonably clear of personal belongings, vehicles, pets, or other obstructions.
If Blue Goat Landscape Services is unable to access the property or work area because of conditions outside the Company’s control, the service may need to be rescheduled and applicable charges may apply.
Routine lawn and landscape maintenance services are intended to maintain the appearance and general condition of the property.
Lawn and plant health can be affected by weather, irrigation, soil conditions, pests, disease, environmental conditions, animals, construction activity, and other factors outside the Company’s control.
Blue Goat Landscape Services does not guarantee that grass, plants, shrubs, trees, or other vegetation will remain healthy or survive following maintenance or installation unless a specific written warranty is provided.
Blue Goat Landscape Services will use reasonable care when installing plants, shrubs, flowers, trees, mulch, soil, and other landscape materials.
Plant survival depends on factors including watering, weather, soil conditions, sunlight, pests, disease, maintenance, and other environmental conditions.
Unless specifically stated in writing, Blue Goat Landscape Services does not guarantee plant survival after installation.
The Customer is responsible for providing appropriate watering and care after installation unless ongoing maintenance has been specifically included in the approved service agreement.
Landscaping and irrigation work may be affected by rain, extreme temperatures, storms, saturated soil, unsafe working conditions, or other weather-related conditions.
Blue Goat Landscape Services may postpone or reschedule work when weather or site conditions make it unsafe or impractical to perform the services properly.
Weather-related delays do not constitute a breach of the agreement.
Upon completion, the Customer is encouraged to inspect the work and notify Blue Goat Landscape Services of any concerns regarding the completed scope.
Blue Goat Landscape Services will make a reasonable effort to address legitimate workmanship concerns related to the approved scope.
Minor variations in plant appearance, soil, mulch, grass, landscape materials, or other natural products are considered normal and are not necessarily defects.
Any specific workmanship or product warranty offered by Blue Goat Landscape Services will be stated in writing on the applicable estimate, invoice, proposal, or service agreement.
Unless otherwise stated in writing, no additional express or implied warranty is provided for existing systems, existing landscaping, plants, irrigation components, or materials not supplied or installed by Blue Goat Landscape Services.
Manufacturer warranties, when applicable, remain subject to the manufacturer’s terms and conditions.
Payment is due according to the payment terms stated on the approved estimate, invoice, proposal, or service agreement.
Unless otherwise stated in writing, invoices are due upon completion of the work or according to the payment schedule agreed upon by the Customer and Blue Goat Landscape Services.
The Customer agrees to pay all approved charges, including applicable labor, materials, equipment, delivery, disposal, and authorized additional work.
Accounts that are not paid according to the agreed payment terms may be considered past due.
Blue Goat Landscape Services reserves the right to suspend additional services or future work until outstanding balances are paid.
The Customer may also be responsible for reasonable costs associated with collection of unpaid amounts to the extent permitted by applicable law.
If an invoice remains unpaid, Blue Goat Landscape Services may take appropriate steps to collect the outstanding balance.
Depending on the circumstances and applicable law, such steps may include written payment demands, collection efforts, or legal remedies available to the Company.
The Company reserves all rights and remedies available under applicable law.
Either party may request cancellation or termination of ongoing services subject to the terms of the applicable service agreement.
If the Customer cancels a project after materials have been purchased, labor has been scheduled, or work has begun, the Customer may be responsible for costs already incurred by Blue Goat Landscape Services, including approved materials, labor, delivery, equipment, disposal, and other non-refundable project expenses.
Blue Goat Landscape Services may suspend or terminate services when the Customer fails to make required payments, repeatedly changes the scope of work, denies reasonable access to the property, or otherwise materially interferes with the Company’s ability to perform the agreed services.
Blue Goat Landscape Services will use reasonable care when performing services.
The Company is not responsible for damage resulting from pre-existing conditions, improperly installed or concealed systems, underground utilities or irrigation components that were not properly identified, or conditions outside the Company’s reasonable control.
The Customer is responsible for identifying and communicating known underground utilities, private lines, irrigation systems, landscape lighting, or other concealed property features before work begins.
The Customer is responsible for providing accurate information regarding the property and notifying Blue Goat Landscape Services of known conditions that may affect the work.
The Customer should notify Blue Goat Landscape Services of known irrigation lines, underground utilities, landscape lighting, septic systems, private utility lines, or other concealed structures in or around the work area.
Failure to disclose known conditions may result in additional costs or delays.
Blue Goat Landscape Services may photograph or document completed work for project records, quality-control purposes, estimates, invoices, and documentation of existing or completed conditions.
Photographs may be used to document the condition of the property before, during, or after work.
Any use of photographs for advertising or promotional purposes may be subject to applicable privacy requirements and separate authorization when required.
To the fullest extent permitted by applicable law, Blue Goat Landscape Services will not be responsible for indirect, incidental, consequential, or special damages arising from services performed under an agreement, except where such limitation is prohibited by law.
Blue Goat Landscape Services’ responsibility, where legally applicable, is limited to the services and scope specifically agreed upon between the parties.
Nothing in these Terms is intended to waive any rights or protections that cannot legally be waived.
After irrigation or sprinkler work is completed, the Customer is responsible for monitoring the system and notifying Blue Goat Landscape Services of any issues discovered after service.
Irrigation systems should be periodically inspected because components may fail due to age, normal wear, water pressure, weather, underground conditions, electrical issues, or other causes.
An irrigation repair or adjustment does not constitute a guarantee that the entire existing irrigation system will remain operational indefinitely.
Blue Goat Landscape Services reserves the right to stop or postpone work when conditions are unsafe for employees, contractors, customers, or property.
Unsafe conditions may include severe weather, unstable structures, hazardous materials, aggressive animals, dangerous property conditions, or other circumstances that could reasonably create a safety risk.
Work may resume once the unsafe condition has been reasonably addressed.
The approved estimate, proposal, work order, service agreement, invoice, and these Terms & Conditions constitute the agreement between Blue Goat Landscape Services and the Customer regarding the services described therein.
Any modification to the scope, price, or material terms should be documented in writing whenever reasonably practical.
If there is a conflict between these Terms and a specific written provision in an approved proposal or service agreement, the specific written provision may control for that particular project.
If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Texas, to the extent applicable.
By approving an estimate, proposal, work order, service agreement, invoice, or otherwise authorizing Blue Goat Landscape Services to begin work, the Customer acknowledges that they have had an opportunity to review these Terms & Conditions and agrees to be bound by them.
The Customer understands that additional charges may apply when work is requested outside the original approved scope or when additional labor or materials are reasonably required to complete authorized work.
